1. Acceptance of Terms

These Terms & Conditions (“Terms”) govern your access to and use of smoothkidswear.com (the “Service”) operated by Smooth Kids (“we”, “us”, or “our”). By browsing, registering, or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Definitions

  • “Product(s)” — any item listed for sale on the Service.
  • “Order” — a request from you to purchase Products.
  • “Customer” — the individual placing an Order.
  • “Service” — our website and all related services.

3. Use of the Service

You agree to use the Service only for lawful purposes. You must not:

  • Use the Service in any way that violates Indonesian law.
  • Attempt to gain unauthorized access to any part of the Service, customer accounts, or our internal systems.
  • Use automated tools (bots, scrapers) to extract data without our written consent.
  • Interfere with the proper functioning of the Service (e.g. distributed denial-of-service attacks).
  • Submit false, inaccurate, or misleading information when placing an order or creating an account.

4. Account

Creating an account is optional — you may check out as a guest. If you create an account, you are responsible for safeguarding your password and for any activity under your account. Notify us immediately at smoothkids833@gmail.com if you suspect unauthorized use of your account.

5. Products and Pricing

  • All Products are displayed in Indonesian Rupiah (IDR) unless otherwise stated.
  • Prices include applicable taxes where required by law. Shipping costs are calculated at checkout based on destination and weight.
  • We make every effort to display Product colours and features accurately, but device screens may vary. We cannot guarantee that Product images will exactly match the physical item.
  • Product availability is subject to change without notice. An Order confirmation does not guarantee stock; we will notify you if a Product becomes unavailable after you place an Order.
  • We reserve the right to correct typographical errors in pricing or Product descriptions, and to cancel Orders affected by such errors with a full refund.

6. Ordering

  • Placing an Order constitutes an offer to purchase, which we may accept or decline at our discretion. We may decline Orders for any reason, including suspected fraud or unverifiable payment.
  • An Order is confirmed when you receive an Order ID by email or on the order confirmation page.
  • By placing an Order you confirm that the information provided (name, address, contact) is accurate and complete.

7. Payment

  • We accept payments processed by Xendit, including virtual account transfers, QRIS, and e-wallets. Card details are handled entirely by Xendit; we never see or store them.
  • Payment must be received in full before we ship your Order.
  • If payment is not received within the invoice validity window (typically 24 hours), the Order will be cancelled automatically.
  • We reserve the right to refuse or refund any Order for suspected fraud or unauthorized payment.

8. Shipping

  • Domestic shipments within Indonesia are fulfilled by Biteship using the courier you select at checkout.
  • International shipments are fulfilled via RajaOngkir using POS International, TIKI WPX, or JNE International.
  • Estimated delivery times provided at checkout are estimates from the courier and are not guaranteed.
  • Risk of loss passes to you when the parcel is handed to the courier. We are not liable for parcels lost or delayed after handover, but we will assist you with claims against the courier where possible.
  • International Orders may be subject to customs duties and taxes in the destination country. These are the Customer’s responsibility.

9. Returns and Refunds

  • Products may be returned within 7 (seven) days of receipt if defective, damaged in transit, or significantly different from what was ordered.
  • Products must be unused, unworn, in original packaging, and with all tags attached.
  • To request a return, contact us within 7 days at smoothkids833@gmail.com with your Order ID and reason.
  • Approved refunds are issued to the original payment method within 10 (ten) business days of receiving the returned item.
  • Shipping costs are non-refundable except when the return is due to our error (wrong or defective item).
  • Sale or clearance items are final sale and not eligible for return unless defective.

10. Warranty

We warrant that Products are free from manufacturing defects at the time of delivery. This warranty does not cover:

  • Damage caused by misuse, neglect, or normal wear and tear.
  • Products modified or repaired by third parties.
  • Slight variations in colour, fabric, or finish inherent to the manufacturing process.

11. Intellectual Property

All content on the Service — including the Smooth Kids name, logo, text, graphics, photos, designs, and software — is owned by us or licensed to us and protected by Indonesian and international intellectual property laws. You may not copy, reproduce, or use any content without our prior written consent.

12. User Content

If you submit reviews, photos, or other content to the Service, you grant us a non-exclusive, royalty-free license to display, reproduce, and use that content for the purpose of operating and promoting the Service. You confirm you own the rights to any content you submit and that it does not violate any third party’s rights.

13. Limitation of Liability

To the maximum extent permitted by law, the Service is provided “as is” without warranty of any kind. We are not liable for indirect, incidental, special, or consequential damages, including loss of profits, data, or goodwill, arising out of or related to the Service or any Product purchased through it. Our total liability for any claim shall not exceed the amount you paid us in the relevant Order.

14. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including legal fees) arising out of your breach of these Terms or your misuse of the Service.

15. Force Majeure

We are not liable for failure to perform our obligations when such failure is caused by events beyond our reasonable control, including natural disasters, pandemics, government action, courier disruptions, or internet/infrastructure failures.

16. Governing Law

These Terms are governed by the laws of the Republic of Indonesia. Any dispute arising out of or related to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. Failing that, the dispute shall be submitted to the jurisdiction of the courts of Bandung, Indonesia.

17. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date above indicates the latest revision. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
